Selling or buying in Waukee? How does a real estate lawyer help?
Waukee homes record in Dallas County, not Polk. Danilson Law represents Waukee sellers, plus buyers who are paying cash or buying on an installment contract. We review the purchase agreement, prepare the deed and closing papers, answer title questions, and run the closing. We don't handle closings for mortgage lenders, and our work is limited to Iowa real estate. Book a free 15-minute discovery call with attorney Jeremy Danilson, and we'll quote a flat fee before work begins.

What legal work do Waukee sellers and cash buyers bring to us?
Waukee sellers usually want the purchase agreement checked and the closing handled. Cash or contract buyers want someone on their side who reads the title and closes the deal. Owners may need a quit claim deed or to add a spouse or child to title, and we write title opinions. A direct-sale seller with a buyer and no agent gets the whole transaction handled.
The Census Bureau's estimates put Waukee at 23,949 people in its 2020 base and 34,420 in July 2024, a jump of about 44 percent. Fast growth means new subdivisions, and new subdivisions bring recorded plats, covenants, and sometimes owners' associations into the title work.

Where is a Waukee deed recorded, and who sets the taxes?
Waukee is a Dallas County city, so your deed records in Adel, the county seat. The Dallas County Recorder takes the deed or contract and the transfer tax. The Declaration of Value is filed with the Dallas County Recorder along with the deed or contract, and the Dallas County Treasurer collects property tax. All three are at 800 Court St. in Adel, and we handle the recording, so you don't make the trip.
Dallas
Recorder: Dallas County Recorder, 800 Court St., Suite 130, Adel
Assessor: Dallas County Assessor, 800 Court St., Room 120, Adel
Treasurer: Dallas County Treasurer, 800 Court St., Suite 111, Adel
How does a Waukee tax bill break down?
On the City of Waukee's fiscal year 2026 breakdown, the schools take the largest share of the levy, then the city, then Dallas County. At closing we prorate taxes from the Dallas County Treasurer's figures for your parcel, not from an average.
What has to be filed along with a Waukee deed?
Most Iowa deeds and real estate contracts need a Declaration of Value, and you pay the state transfer tax to the county recorder when you record. Many tax-free transfers, like gifts between spouses or from parent to child, don't need a Declaration of Value. Some do, though, including real estate contracts. See the Iowa Legislature's transfer tax chapter.
When a transfer needs a Declaration of Value, the seller must also file a groundwater hazard statement. If the property has no wells, septic system, burial site, underground tank or waste site, the seller can instead put a "no known conditions" sentence on the first page of the deed. Without it, the recorder will refuse to record the document.
Do septic rules matter near the edge of Waukee?
They can. Waukee's own code has a chapter on on-site wastewater systems, so don't assume every lot is on city sewer. If a home with 1 to 4 units uses a private septic system, a DNR-certified inspector must inspect it before the deed or contract can be recorded, and that includes when you sign a seller-financed contract. Some transfers are exempt, such as transfers between spouses or to children, estate transfers, and systems installed in the last two years. If weather delays the inspection, the buyer can sign a binding agreement with the county board of health to have it done later. See the Iowa DNR time-of-transfer page.
Does Waukee require anything from you when a rental changes hands?
Waukee requires a rental inspection certificate before anyone rents, leases, or allows occupancy of a dwelling unit or any part of one, including a single sleeping room (Waukee City Code Chapter 156). The certificate is good for two years from the date it's issued. A property that received a certificate of occupancy in the previous two years doesn't need the rental inspection yet (City of Waukee, Rental Code Enforcement).
Selling a rented Waukee home, or have a buyer who plans to rent? We'll flag the certificate in the purchase agreement and point your buyer to Waukee Development Services (515-978-9533) to confirm its status.
What if you sell your Waukee home on contract?
In Iowa, the seller must record a contract for the sale of a home with the county recorder within 90 days of signing, or within 30 days for sellers who have signed four or more home contracts in the past year. Late recording can bring a fine of up to $100 a day, and the seller can't start a forfeiture until the contract is recorded. See the Iowa Legislature's installment contract recording rules. For a Waukee home, the contract records with the Dallas County Recorder in Adel. We prepare the contract and the filings and get it recorded on time.
How far is our office from Waukee, and do you need to come in?
Our office at 6165 NW 86th St. in Johnston is about 19 minutes from most of Waukee. You don't need to come in unless you want to. We can do the call by phone or video, and you can sign through remote online notarization or at a scheduled signing. We do not have a Waukee office.
Waukee stretches from Historic Triangle Park downtown, at Ashworth Drive and 6th Street, to the Kettlestone District along Grand Prairie Parkway. The Raccoon River Valley Trail starts at the Waukee Trailhead on the north side of Hickman Road near 10th Street, and Triumph Park sits north of Hickman next to Waukee's Northwest High School.
Waukee real estate FAQs
Not according to the U.S. Census Bureau, which lists Waukee entirely within Dallas County. Your deed records with the Dallas County Recorder in Adel, and taxes are prorated from Dallas County figures. Some nearby addresses in the metro do sit in Polk County, so we confirm the county from your legal description before anything is signed.
If it's rented, it needs a valid Waukee rental inspection certificate, and a certificate lasts two years. If your buyer keeps renting the home, it must have a valid Waukee rental certificate. We'll check with the city whether the current one carries over.
Not right away. Under the city's rental program, a property that received a certificate of occupancy within the previous two years doesn't need a rental inspection yet. After that, the two-year certificate cycle applies.
Then the state rule applies. If the home uses a private septic system, the state's time-of-transfer inspection applies before the deed or contract can be recorded in Adel. Tell us early so the inspection doesn't hold up your closing date.
No. You can sign through remote online notarization or at a scheduled signing, and we handle recording with Dallas County.
